Article 1 – Scope of Application
These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) apply to all offers, orders, sales and deliveries of products sold through the website www.nitril.lu and by Hoffmann Group.
They apply to all customers, whether professional or private individuals (hereinafter referred to as the “Customer”).
By placing an order, the Customer fully and unconditionally accepts these terms and conditions.
These GTC prevail over any other conditions unless expressly agreed otherwise in writing by Hoffmann Group.

Article 3 – Products
Nitril.lu sells disposable nitrile gloves and related protective products.
Product descriptions, specifications, images, and technical information presented on the website are provided for informational purposes only.
Minor variations in packaging, color, or branding may occur depending on manufacturers or suppliers.
Article 4 – Orders
Orders may be placed through the website www.nitril.lu or through other written communication accepted by Hoffmann Group.
A contract is considered concluded when:

the Customer places an order, and
-
Hoffmann Group confirms the order or begins processing it.
Hoffmann Group reserves the right to refuse or cancel any order in the following situations:

product unavailability
-
incorrect pricing due to technical error
-
suspected fraud or misuse
-
payment problems
Article 5 – Prices
All prices are expressed in Euro (€).
Prices may be shown including or excluding VAT, depending on the customer category (private or professional).
Shipping costs may be added at checkout.
Hoffmann Group reserves the right to change prices at any time.
However, the price applied to an order will always be the one valid at the moment the order is confirmed.
Article 6 – Payment
Payment must be made using the methods available on the website.
Accepted payment methods may include:

credit or debit card

online payment providers
-
bank transfer (if offered)
Orders may only be processed after successful payment.
In the event of non-payment or delayed payment for professional customers, Hoffmann Group reserves the right to suspend or cancel deliveries.
Article 7 – Delivery
Deliveries are made to the address indicated by the Customer when placing the order.
Estimated delivery times:

Luxembourg: 1–2 working days

Belgium / France / Germany: 2–4 working days

Other EU countries: depending on destination
Delivery times are indicative and may vary due to logistics or transport conditions.
Hoffmann Group cannot be held responsible for delays caused by transport carriers or circumstances beyond its control.
Article 8 – Inspection of Goods
The Customer must check the condition and conformity of the goods upon delivery.
Any complaint regarding damaged or missing products must be reported within 8 calendar days after receipt of the goods.
If damage is visible upon delivery, the Customer must immediately notify the carrier and report it to Hoffmann Group.
After this period, the goods will be considered accepted without reservation.
Article 9 – Returns
No return of goods will be accepted without the prior written approval of Hoffmann Group.
Returned goods must:

be unused
-
remain unopened
-
be in their original packaging
-
be in resalable condition
Return shipping costs are the responsibility of the Customer unless the product is defective or incorrectly delivered.
Article 10 – Retention of Title
All goods delivered remain the property of Hoffmann Group until full payment of all amounts due has been received.
Until full payment has been made, the Customer agrees not to resell, transfer, or modify the goods.
In the event of non-payment, Hoffmann Group reserves the right to reclaim the goods.
Article 11 – Liability
Hoffmann Group guarantees that the products supplied correspond to the agreed specifications.
However, Hoffmann Group cannot guarantee suitability for a specific use unless explicitly agreed in writing.
In the event of a proven defect, Hoffmann Group may choose to:

replace the product, or
-
refund the purchase price.
No other compensation shall be granted.
Hoffmann Group shall not be liable for indirect damages such as:

loss of business
-
loss of profit
-
loss of data
-
or any other consequential damages.
Article 12 – Proper Use of Products
The Customer must use the products according to their intended purpose.
Disposable nitrile gloves are designed for single use only.
Hoffmann Group shall not be responsible for damages resulting from:

improper use
-
misuse
-
incorrect storage
-
modifications of the products.
Article 13 – Limitation of Liability
The total liability of Hoffmann Group, regardless of the cause, shall in no case exceed the value of the products purchased.
Under no circumstances shall Hoffmann Group be liable for indirect or financial damages suffered by the Customer or third parties.
Article 14 – Data Protection (GDPR)
Hoffmann Group processes personal data in accordance with the General Data Protection Regulation (GDPR).
Customer data is used only for:

order processing
-
customer service
-
administrative purposes
Customers may exercise their rights of access, correction, or deletion of their personal data by contacting Hoffmann Group.
Article 15 – Intellectual Property
All elements of the website www.nitril.lu, including:

images
-
graphics
-
logos
-
design
remain the exclusive property of Hoffmann Group.
Any reproduction, distribution, or use without prior written permission is strictly prohibited.
Article 16 – Force Majeure
Hoffmann Group shall not be held responsible for delays or failure to fulfill obligations due to events beyond its control, including but not limited to:

supply shortages

transportation disruptions

Article 17 – Applicable Law and Jurisdiction
These General Terms and Conditions are governed by the laws of Luxembourg.
Any dispute relating to the interpretation or execution of these terms shall fall under the exclusive jurisdiction of the courts of Luxembourg.
Article 18 – Severability
If any provision of these terms is declared invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.
